Please read these terms carefully before using this website or purchasing.
These Terms and Conditions (“Terms”) govern the purchase and use of services and products offered by Tara Kermiet Consulting, LLC (“Company,” “we,” “us,” or “our”) through our website and checkout. By purchasing any service or product, you (“Client,” “you,” or “your”) agree to these Terms.
1. Services and products
We offer various coaching sessions, programs, digital resources, and workshops (collectively, “Services”). The specific details, pricing, and inclusions of each Service are outlined in the product description at checkout.
2. Payment terms and refunds
- Payment method: All payments must be made through our checkout using credit/debit cards or other available payment methods.
- No refunds: All sales are final. Refunds are not provided for unused sessions, digital products, or cancellations, except where the law where you live requires otherwise (see “Your legal rights” below).
- Payment in full: Payment is required in full at the time of purchase, unless a payment plan is offered at checkout.
- Payment plans: If you choose a payment plan, you agree to pay every installment on its due date, and the full price remains owed even if you cancel, stop attending, or stop using the Services. If a payment fails, we may retry the card and may pause your access until the balance is current. If an installment stays unpaid, we may end the Services, and the unpaid balance is still due.
- Your legal rights: Some countries and states give buyers cancellation or refund rights for services and digital products that cannot be waived by contract. Nothing in these Terms limits those rights. For digital products delivered right away, you ask for immediate access when you buy, and where the law allows, you acknowledge that doing so may end any cooling-off period.
3. Client responsibilities
By purchasing, you agree to:
- Provide accurate and complete information as requested to ensure the delivery of Services.
- Attend scheduled sessions on time and as agreed.
- Submit any required materials (for example, resumes, job postings, surveys, assessments) in advance if applicable.
4. One-on-one session scheduling, cancellations, and attendance
This section applies to one-on-one coaching sessions and session packages. The 90-day coaching program and group programs have their own terms in Sections 5 and 6.
- Scheduling: Sessions are scheduled through the online booking system or as otherwise agreed.
- Cancellation policy: You may reschedule or cancel a session with at least 24 hours’ written notice. Sessions canceled with less than 24 hours’ notice or no-shows will be forfeited.
- Tardiness: Out of respect for both our time, sessions begin and end promptly as scheduled. Clients who do not join within 15 minutes of the scheduled start time will be considered a no-show, and the session will be forfeited.
- Expiration: Coaching sessions are designed to be used within a focused window to support momentum and continuity. All purchased coaching sessions or packages must be used within 6 months from the original date of purchase, unless otherwise stated in writing. Any unused sessions after this period will expire and are forfeited.
- Extensions: Extensions are not guaranteed and may be granted only with prior written approval at the Company’s sole discretion for extenuating circumstances.
5. 90-day coaching
- What’s included: A one-hour kickoff session, voice or text messaging with me on weekdays, 15-minute pulse checks booked one at a time as needed, one review item per week, and learning materials I choose for you. Access to Career Pivot Lock In cohort materials may be included as described at checkout. Cohort materials do not include access to the cohort community unless stated.
- Start and end: The 90 days begin on the date of your kickoff session. Please schedule your kickoff within 14 days of purchase. If you haven’t, the 90 days begin on the 15th day after purchase. Access ends at day 90.
- No carryover: Unused pulse checks, review items, and messages do not roll over, extend the 90 days, or convert to a refund or credit.
- Messaging: I respond on weekdays. Messages are not monitored on weekends or holidays, and messaging is not an emergency or crisis service. If you are in crisis, contact local emergency services or a crisis line.
- Planned time off: I will tell you in advance about planned time off, including December 2026, when live calls pause. Voice notes may continue during that time. Unless we agree otherwise in writing, the 90 days are not extended for planned time off.
- Payment: Section 2 applies, including the payment plan terms.
6. Group programs and workshops
- Missed sessions: If you miss a live group session, you are not entitled to a refund, credit, or make-up session. If a recording is available for the program, I will share it.
- Cancellations and transfers: Because group seats are limited, enrollment in a group program is final once you purchase. Transfers to another person or to a later cohort are not guaranteed and may be granted only with prior written approval.
- If we cancel or reschedule: If we cancel a group program before it starts, you may choose a full refund or a spot in the next run. If we reschedule it, your enrollment moves to the new date.
- Fees applied to coaching: Where a group session fee is described as applied toward coaching, the credit is applied once, to one coaching purchase made within 14 days after the date of your group session. It has no cash value, cannot be transferred, and is not refundable.
7. Corporate, speaking, and team engagements
Corporate workshops, consulting, speaking, and team engagements are governed by a separate written agreement or statement of work. If that agreement conflicts with these Terms, the agreement controls.
8. Confidentiality
We respect your privacy and will keep your information confidential, except where disclosure is required by law. Coaching is not therapy, and certain issues may be referred to a licensed professional if deemed necessary.
9. Artificial intelligence and technology use
In delivering our Services, we may use AI-powered tools to enhance the quality and efficiency of our coaching, including but not limited to AI-assisted note-taking during sessions and AI writing or planning tools used in session preparation and follow-up.
Where AI note-taking is used during live sessions, clients will be notified prior to or at the start of the session. While session-based tools may process your name and session content as part of their functionality, any client information used outside of live sessions is handled with care and anonymized where possible to protect your privacy.
Any information processed through these tools remains subject to our confidentiality practices outlined in Section 8, and we do not intentionally share identifying client information beyond what is necessary to deliver our Services.
10. Use of anonymized insights in educational and published content
In the course of delivering coaching services, anonymized themes, patterns, and insights may emerge that are valuable for broader educational purposes. The Company may use such anonymized material in published content, including but not limited to articles, newsletters, social media content, courses, presentations, workshops, and books.
No identifying information, including your name, employer, industry, location, or other details that could reasonably identify you, will be included in any such materials. All published references will be fully anonymized and may be combined with patterns observed across multiple clients.
If you wish to opt out of this use, you may do so by notifying us in writing at [email protected] prior to or during your coaching engagement. Opting out will not affect the quality or delivery of your Services in any way.
11. Intellectual property
All materials, frameworks, and resources provided are owned by Tara Kermiet Consulting, LLC. You may not reproduce, share, or distribute these materials without express written consent.
12. No guarantees
Coaching and related services are designed to provide tools, insights, and strategies, but success depends on your participation and implementation. We do not guarantee specific results, such as job placement or promotions.
13. Termination of services
We reserve the right to terminate services for non-compliance with these Terms, inappropriate conduct, or failure to provide required materials. No refunds will be issued for terminated services, except where the law requires otherwise.
14. Limitation of liability
To the fullest extent permitted by law, Tara Kermiet Consulting, LLC shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of our Services.
15. Governing law
These Terms are governed by the laws of the State of North Carolina. Any disputes shall be resolved exclusively in the courts located in Brunswick County, North Carolina.
16. Amendments
We reserve the right to update or modify these Terms at any time. Updated Terms will be posted, and continued purchases or use of Services constitutes acceptance of the updated Terms.
By completing your purchase, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.
